Driver hereby states that has knowledge of boating rules and regulations and safety procedures and pledges that he will operate the boat in a safe and reasonable manner so as not to cause damage to the boat, the equipment thereon, or to any person or persons either within or outside the boat.

Driver shall assume all liability for any and all damage to the boat, the equipment thereon, or to any person or persons either within or outside the boat, which occurs in any manner from any cause or causes during Driver’s possession of the boat and/or participation in the Race and shall indemnify and save Lake Shooters 21, Inc., Osage Beach Fire Protection District, Mid-County Fire Protection District, Sunrise Beach Fire Protection District, Gravois Fire Protection District, Lake Ozark Fire Protection District (Race Hosts), and their agents, harmless from and against all claims, costs, expenses, damages, and including personal injury, death, or property damage claims arising or in any manner occasioned by the operation or use of the boat, during the period of Driver’s possession of the boat and/or participation in the Race.

Driver agrees to fully exonerate, indemnify and hold harmless Race Hosts and their agents, from and against all claims or actions and all expenses and costs (including attorney’s fees) incidental to the defense of any such claims or actions based upon or arising out of damage or injury (including death) to person or property caused by or sustained in connection with the performance of this Agreement, or by conditions created thereby, and, if requested by Race Hosts or their agents, to assume without expense or cost to Lake Shooters 21, Inc., Osage Beach Fire Protection District, Mid-County Fire Protection District, Sunrise Beach Fire Protection District, Gravois Fire Protection District, Lake Ozark Fire Protection District, or their agents, the defense of any such claims or actions.

The ANNUAL LAKE RESCUE SHOOTOUT, LAKE RESCUE SHOOTOUT and all related trademarks, logos, designs and taglines (hereinafter “Trademarks”) are the property of ALRS.  The use of any Trademarks shall inure to the benefit of ALRS and all proposed uses of the Trademarks shall be subject to ALRS’ review and prior written approval.  ALRS is the owner of all copyrights associated with the Race.  All photos, films, video, written materials and other memorializations of the Race, in any and all form and media are the property of ALRS.  ALRS permits Driver and his agents to use cameras or video cameras only to the extent that any resulting photographs, film or video are used for the Driver’s personal use.  In all cases, the resale of photography, film or video is strictly prohibited.
